Agreement to terms

These Terms and Conditions (“Terms”) govern your access to and use of Logato, a music practice optimization application (“the Service”), operated by us. By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Eligibility

You must be at least 13 years old to use Logato. By using the Service, you represent and warrant that you meet this age requirement. If you are between 13 and 18 years old, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

Account registration and security

To use Logato, you must create an account with a valid email address and password. You are responsible for:

  • Providing accurate and truthful registration information
  • Maintaining the confidentiality of your password
  • All activity that occurs under your account
  • Notifying us immediately if you suspect unauthorized access to your account

We reserve the right to suspend or terminate accounts that we determine have been compromised or are being used in violation of these Terms.

Description of service

Logato provides a data-driven music practice system: a library of the material you practice, generated practice sessions, a tempo ladder, mastery measurement, spaced-repetition scheduling, plans, and optional email practice reminders. Teachers can invite students, send material and review practice with the student’s consent.

Logato is a tool to support your practice. It does not guarantee specific learning outcomes, skill improvements or results. Progress depends on your own consistent effort and practice.

Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Attempt to gain unauthorized access to any part of the Service or its infrastructure
  • Reverse engineer, decompile or otherwise attempt to extract source code from the Service
  • Interfere with or disrupt the Service, its servers, or networks connected to it
  • Use automated scripts, bots or scraping tools against the Service without our written consent (apps you connect through the Service’s own connection flow are allowed)
  • Impersonate any person or entity, or falsely represent your affiliation with any person or entity
  • Upload material that is harmful or offensive, or that infringes the rights of any third party

Intellectual property

The Service, including its design, scheduling algorithms, content and underlying code, is owned by us and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Service for your personal music practice and, if you use a Teacher plan, your teaching.

You retain ownership of any content you add to the Service (such as your items, notes, recordings and plans). By submitting such content, you grant us a limited license to store and process it solely for the purpose of providing the Service to you. You are responsible for having the right to add the material you import or attach.

You may not copy, reproduce, distribute, modify or adapt the Service or its content without our prior written consent.

Subscriptions and billing

Logato offers a free plan and paid “Pro” and “Teacher” plans, billed monthly or annually. Current pricing and what each plan includes are published on our pricing page.

  • Free trial: a trial of Pro, without a card, may start the first time you open a Pro feature. There is one trial per account. When it ends, your account returns to the Free plan unless you subscribe.
  • Payment processing: all payments are processed by Stripe. Your card details are provided directly to Stripe and are never received or stored by Logato. See Stripe’s Privacy Policy.
  • Billing data we retain: your Stripe customer ID and subscription status, so we can apply your plan and show your billing state in the app.
  • Automatic renewal: paid plans renew automatically at the end of each billing period until canceled.
  • Cancellation: you may cancel at any time from the Stripe-hosted customer portal, linked from Settings. Cancellation takes effect at the end of your current billing period; you keep your plan until then and are not charged again.
  • After a plan ends: we never delete your data because a plan ended. Anything over a Free limit becomes read-only, and you can always export your data.
  • Students: a student linked to a teacher on a Teacher plan receives Pro features while the link is active. Students are never charged to be taught.
  • Refunds: payments are generally non-refundable. If you believe you were charged in error, contact us at the address below and we will review your request case by case.
  • Price changes: we may change prices from time to time. We will give advance notice, by email or in the app, before a change takes effect for existing subscribers. Continuing your subscription after a change takes effect means you accept the new price.
  • Failed payments: if a renewal payment fails, we may move your account to the Free plan until payment succeeds.

Email communications

By creating an account, you may receive transactional emails related to your account (such as email verification). Practice reminder emails are optional and require your explicit opt-in. You may unsubscribe at any time using the link in every reminder email or in Settings.

Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free or free of harmful components, or that defects will be corrected. We do not warrant that the practice recommendations or scheduling algorithm will produce any particular result or level of musical improvement.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR ANY OTHER INTANGIBLE LOSSES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) FIFTY US DOLLARS ($50).

Account termination

You may stop using the Service at any time, and you can export your data and delete your account in Settings.

We reserve the right to suspend or terminate your account, without prior notice or liability, if we reasonably believe you have violated these Terms or engaged in conduct harmful to the Service, other users or us. Upon termination, your right to use the Service ends immediately.

Changes to terms

We reserve the right to modify these Terms at any time. When we do, we will update the “Last updated” date at the top of this page. Your continued use of the Service after any change means you accept the revised Terms. For material changes, we will make reasonable efforts to notify you in advance, for example by email.

Governing law

These Terms shall be governed by and construed in accordance with the laws of Virginia, USA, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Virginia, USA.
