Agreement to Terms

These Terms and Conditions ("Terms") govern your access to and use of Logato, a music practice optimization application ("the Service"), operated by us. By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Eligibility

You must be at least 13 years old to use Logato. By using the Service, you represent and warrant that you meet this age requirement. If you are between 13 and 18 years old, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

Account Registration and Security

To use Logato, you must create an account with a valid email address and password. You are responsible for:

  • Providing accurate and truthful registration information
  • Maintaining the confidentiality of your password
  • All activity that occurs under your account
  • Notifying us immediately if you suspect unauthorized access to your account

We reserve the right to suspend or terminate accounts that we determine have been compromised or are being used in violation of these Terms.

Description of Service

Logato provides a data-driven music practice scheduling system that uses a spaced repetition algorithm and multi-metric self-assessment to generate personalized practice sessions. The Service includes practice session generation, exercise progress tracking, goal management, focus area selection, and optional email practice reminders.

Logato is a tool to support your practice. It does not guarantee specific learning outcomes, skill improvements, or results. Progress depends on your own consistent effort and practice.

Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Attempt to gain unauthorized access to any part of the Service or its infrastructure
  • Reverse engineer, decompile, or otherwise attempt to extract source code from the Service
  • Interfere with or disrupt the Service, its servers, or networks connected to it
  • Use automated scripts, bots, or scraping tools against the Service without our written consent
  • Impersonate any person or entity, or falsely represent your affiliation with any person or entity
  • Transmit any material that is harmful, offensive, or that infringes the rights of any third party

Intellectual Property

The Service, including its design, exercise library, algorithms, content, and underlying code, is owned by us and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial music practice purposes.

You retain ownership of any content you create within the Service (such as custom goals or notes). By submitting such content, you grant us a limited license to store and process it solely for the purpose of providing the Service to you.

You may not copy, reproduce, distribute, modify, or create derivative works based on the Service or its content without our prior written consent.

Subscriptions and Billing

Logato offers a free tier and a paid "Pro" subscription tier, billed either monthly or annually. Current pricing is published on our pricing page.

  • Payment processing— all payments are processed by Stripe, a third-party payment processor. Your card details are provided directly to Stripe and are never received or stored by Logato. See Stripe's Privacy Policy for details on how Stripe handles your payment data.
  • Billing data we retain— we store your Stripe customer ID and subscription status so we can enforce your plan's features and reflect your current billing state in the app.
  • Automatic renewal — Pro subscriptions renew automatically at the end of each billing period (monthly or annually) until canceled.
  • Cancellation — you may cancel your subscription at any time from the Stripe-hosted customer portal, accessible from your account settings. Cancellation takes effect at the end of your current billing period; you retain Pro access until then, and you will not be charged again.
  • Refunds — payments are generally non-refundable. If you believe you were charged in error, contact us at the email address below and we will review your request on a case-by-case basis.
  • Price changes — we may change subscription pricing from time to time. If we do, we will provide advance notice (for example, via email or an in-app notice) before any price change takes effect for existing subscribers. Continuing your subscription after a price change takes effect constitutes acceptance of the new price.
  • Failed payments — if a renewal payment fails, we may downgrade your account to the Free tier until payment is successfully processed.

Email Communications

By creating an account, you may receive transactional emails related to your account (such as email verification). Practice reminder emails are entirely optional and require your explicit opt-in. You may unsubscribe from reminder emails at any time via the link included in every reminder email or from your account settings.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components, or that defects will be corrected. We do not warrant that the practice recommendations or scheduling algorithm will produce any particular result or level of musical improvement.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR ANY OTHER INTANGIBLE LOSSES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) FIFTY US DOLLARS ($50).

Account Termination

You may stop using the Service at any time. To request deletion of your account and associated data, please contact us at the email address below.

We reserve the right to suspend or terminate your account, without prior notice or liability, if we reasonably believe you have violated these Terms or engaged in conduct harmful to the Service, other users, or us. Upon termination, your right to use the Service ceases immediately.

Changes to Terms

We reserve the right to modify these Terms at any time. When we do, we will update the "Last updated" date below. Your continued use of the Service after any changes constitutes acceptance of the revised Terms. For material changes, we will make reasonable efforts to notify you in advance (for example, via the email address associated with your account).

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Virginia, USA, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Virginia, USA.
